We operate this website and are the controller for the processing described below. Big Wave Audio is the brand the products are published under; the full company details of the site operator are in the legal notice.

We have not appointed a data protection officer, and are not required to.

2. In short

This website is built to need as little of your data as it can.

  • Opening a page contacts no other company. No analytics, no advertising, no tracking pixels, no social media buttons. Typefaces, images, audio and video are served from our own domain.
  • Nothing is stored on your device until you use a feature that needs it.
  • Videos do not load until you press play, and we say so before you do.
  • We never sell personal data.

The sections below say the same in the detail the law requires.

3. Visiting the website

The site is hosted by IONOS SE, Germany. Delivering a page means your browser's request is processed, and the server records it.

Recorded for each request:

  • the page or file requested, and the status the server answered with
  • the referring page, if you arrived from a link
  • the browser and device identification your browser sends
  • the time of access
  • your IP address, in full

Legal basis: Article 6(1)(f) GDPR. Our legitimate interest is in delivering the website and keeping it secure and available. Because the address is recorded complete rather than shortened, that interest is weighed against yours - and you can object to this processing at any time, which section 11 explains.

These records are not kept permanently. IONOS deletes them automatically on a rolling basis, once they are no longer needed to operate and secure the site.

IONOS processes this data on our behalf under a data processing agreement, which commits them to processing within the European Union or the European Economic Area.

4. Cookies and information on your device

Nothing is stored on your device. This website sets no cookies, and writes nothing to local storage, session storage or any other browser storage - not on arrival, not while you read, and not after you use the newsletter.

We checked rather than assumed: with the browser's storage inspector open, loading a page, opening the newsletter panel and completing a subscription all left every storage area empty. That is why you are not asked to accept cookies when you arrive - there is nothing to ask about.

The newsletter software (section 6) does describe cookies of its own in its privacy policy, used for a shopping cart and for keeping a customer signed in. Neither feature is in use on this website, and neither cookie appeared in that check.

Playing a video is the one exception, and it is your choice: the YouTube player stores information on your device once you press play. Section 5 says what that involves.

5. Videos on product pages

Product pages show a still image and a play button. That image is stored on our own server, so while you are only looking at the page nothing is requested from YouTube or from Google, and nothing is stored on your device.

When you press play, the player is loaded from youtube-nocookie.com, operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. From that moment Google receives your IP address, information about your browser and device, and the address of the video. Google also places cookies or comparable storage on your device at that point, in order to record playback and to prevent misuse.

Data may also be transmitted to Google LLC in the United States. Google participates in the EU-US Data Privacy Framework, for which the European Commission has issued an adequacy decision confirming a level of protection comparable to that of the European Union.

If you are signed in to a Google account while watching, Google may associate the playback with that account. If you do not want that, sign out of Google before pressing play.

Legal basis: Article 6(1)(a) GDPR. Pressing play is your consent, and the caption under each video says what pressing it causes before you do. There is no consent banner to manage, because there is nothing to withdraw in advance: consent is given per video and only by pressing play. To withdraw it, do not press play again - a player already loaded stops when you leave the page.

6. Newsletter

The newsletter is operated with Moonbase, a storefront and newsletter platform run by Moonbase AS, Norway (company registration number 931 730 258), which acts as our processor. Its subscribe panel is loaded only when you press the subscribe button; before that, no connection to Moonbase is made.

We process the email address you give us, and your name if you choose to enter it, in order to send news and product updates. The name field is optional; leaving it empty does not prevent you from subscribing. Legal basis: Article 6(1)(a) GDPR - your consent. You can withdraw it at any time with effect for the future, using the unsubscribe link in the footer of any mailing or by writing to contact@bigwaveaudio.com.

Moonbase stores subscriber data on servers in Ireland, encrypted at rest. The group also includes a company in the United States, but it handles sales in that region only - no newsletter data is transferred to it. Your address therefore stays within the European Economic Area.

Subscribing is confirmed by a second email: after you enter your address, Moonbase sends a confirmation message, and the subscription only takes effect once you follow the link in it. Every mailing carries a one-click unsubscribe link.

We keep your address for as long as you want the newsletter. Once you unsubscribe it is no longer used for mailings, and Moonbase removes it under the retention rules in their own privacy policy.

The Moonbase software also provides shopping cart and customer account features. These are not in use on this website at present.

The subscribe panel is Moonbase's own, and the privacy policy it links to is theirs rather than this one. It describes what they do as our processor, and it applies alongside this text - so it is worth reading if you subscribe: Moonbase's privacy policy.

7. Writing to us

If you email us, we process your address, your message, and anything else you choose to include, in order to answer you. Legal basis: Article 6(1)(b) GDPR where your message concerns a contract or a step towards one, otherwise Article 6(1)(f) - our legitimate interest in responding to enquiries.

We keep correspondence for as long as dealing with the matter requires, and longer where commercial or tax law requires it.

The contact form asks for your name, your email address and your message, and delivers them to us by email through our own hosting. No form service, no captcha and no other company is involved, and nothing you type is stored in a database.

8. Links to other websites

Product pages link to Native Instruments, where our KONTAKT libraries are sold. Following such a link is an ordinary navigation: we transmit nothing about you, and nothing is loaded from Native Instruments while you are on our pages. Once you arrive there, their privacy policy applies.

9. What we do not do

We state this expressly, so that it is recorded rather than assumed:

  • No web analytics of any kind, and no tag manager.
  • No advertising, remarketing or conversion tracking.
  • No tracking pixels, and no social media plugins or share buttons.
  • No profiling, and no automated decision-making within the meaning of Article 22 GDPR.
  • No sale of personal data, and no sharing of it for anyone else's marketing.
  • Typefaces are stored on our own server and are never requested from Google Fonts or any other font service.

10. Your rights

You have the right to request access to your personal data, to have inaccurate data corrected and incomplete data completed, to have your data erased, to have processing restricted, to object to processing based on our legitimate interests, and to receive data you provided in a structured, commonly used and machine-readable format. Where processing rests on consent, you may withdraw it at any time with effect for the future, without affecting the lawfulness of what was done before.

To exercise any of these, write to contact@bigwaveaudio.com. We may need to ask for information to confirm who you are, and we answer within one month.

Every page is served over HTTPS, so traffic between your browser and our server is encrypted. The website is a set of static files: there is no database of visitor data on our side, and no account you could hold with us.

We update this policy when what we do changes. The version on this page is always the current one, and the date at the top says when it last changed.
